INTENT TO REPLACE AND ADOPT ORDINANCE

 

NOTICE IS HEREBY GIVEN pursuant to the provisions of Minnesota Statutes 375.51, that the Otter Tail County Board of Commissioners intends to replace the “Otter Tail County Animal Health and Control Ordinance” with the “Otter Tail County Animal Bite and Dangerous Dog Ordinance”.

 

The replacement ordinance proposed for adoption will be considered at a meeting of the County Board in the Commissioner’s Room at the Otter Tail County Government Services Center, 515 West Fir Avenue, Fergus Falls, Minnesota, on Tuesday June 12, 2018, at 10:30 a.m.

 

The revision to replace the “Otter Tail County Animal Health and Control Ordinance’, which are to be included in the  “Otter Tail County Animal Bite and Dangerous Dog Ordinance” proposed for adoption are primarily the following: Section II: Definitions for Animal Control Authority, Dangerous Dog, Hearing Officer and Potentially Dangerous Dog; and Section V: Hearing Procedures to provide an appeal process.  

 

Copies of the “Otter Tail County Animal Bite and Dangerous Dog Ordinance” are available on the Otter Tail County website http://www.co.otter-tail.mn.us/1098/Ordinances-Policies, at the County Administrator’s office and at the Otter Tail County Auditor-Treasurer’s office located in the Government Services Center (510 Fir Ave W, Fergus Falls, MN).

 

All interested persons are invited to attend the hearing or submit written testimony prior to the hearing date. Written testimony should be submitted to the County Administrator’s office, 520 West Fir Ave, Fergus Falls, MN 56537.

The regular meeting of the Board of Education of Independent School District 547, Parkers Prairie Public Schools, was called to order by Lyle Oeltjenbruns at 7:00 p.m.  Board members present:  Sheryl Myers, Glenn Cornish, Judy Moeller, Scott Wagner and Jeff Samuelson.  Absent: Steve Inwards. Student Board Members present: None.  Administration present: Superintendent Tom Ames, Secondary Principal Carey Johnson and Elementary Principal Steve Radtke. Also present:  Tamara Ellsworth, Dean Yocum and Jennifer Marquardt.

Motion by Myers, seconded by Wagner and carried, to approve the agenda. 

Motion by Moeller, seconded by Cornish and carried, to approve the minutes from the April regular board meeting.

Motion by Cornish, seconded by Wagner and carried, to approve Hand Payable checks totaling $86,298.24; Wire transfers totaling $156,455.60 and Board Payable I checks totaling $104,288.98.  There were no Board Payable II checks.

Superintendent Report:

    •    Superintendent Ames discussed the case currently before the Supreme Court regarding union fair share.

    •    Superintendent Ames provided an update on recent Legislative developments.

    •    Superintendent Ames provided information on five Legislative proposals.

    •    Emergency School Aid was discussed.

    •    Principal Reports:

    o    Principal Radtke

    o    The 5th grade Math Masters team recently competed and finished 3rd out of 36 teams.

    o    Dads and Donuts was held on May 4th.

    o    Preschool graduation for 33 students was held.  Thank you to all of the teachers and staff who worked with the students.

    o    On April 17th, several school staff met at City Hall to discuss procedures in the event of a school shooting.

    o    Principal Johnson

    o    MCA testing is complete, scores are up 4.2%.  

    o    An update on JMC was given.

    o    Jon Oestreich will be teaching the Computer 7 class next year.  He will be offering a Robotics extra-curricular course as well.

    o    Scott Marquardt will head a walk for Mental Health on May 20th, 4PM.

    •    A RESOLUTION TO ACCEPT DONATIONS was introduced by member Myers, seconded by Cornish and passed unanimously. 

WHEREAS, the District 547 School Board encourages the support of the district’s educational programs through the funding and support of grant opportunities and donations that meet the goals and objectives of the school district; 

WHEREAS, the school district will control and maintain all grants and donations to ensure that the interests of all students are met; 

WHEREAS, the grants and donations listed below have been reviewed and approved by the administration of School District 547; 

THEREFORE, BE IT RESOLVED, by the School Board of Independent School District No. 547, State of Minnesota, to accept the following donations:

    •    Millerville Fire Department Relief Association for a donation of $500 in support of the Clay Trap Shooting Team.

    •    Alex Pro Firearms LLC for a donation of $400 in support of the Clay Trap Shooting Team.

    •    Rod & Pam Helling for a donation of $100 in support of the 8th Grade Science Trip to South Dakota.

    •    Pride of Parkers Prairie Lions for a donation of $500 in support of the Top 20 Training for students in grades 7 and 8.

CITY OF PARKERS PRAIRIE, MINNESOTA

 

ORDINANCE NO. 2018-02

 

AN ORDINANCE REGULATING NONESSENTIAL WATER USAGE UPON CRITICAL WATER DEFICIENCY AS AUTHORIZED BY MINN. STAT. § 103G.291, SUBD. 1 AND 2.

 

 

The City Council of Parkers Prairie, Minnesota ordains:

 

SECTION 1. PURPOSE.

This ordinance establishes water conservation restrictions; and the plan will be in effect at any time the governor declares by executive order a critical water deficiency, pursuant to Minnesota Statutes section 103G.291. 

 

SECTION 2. DEFINITIONS.

2.1 Clerk in statutory cities means the person assigned duties pursuant to Minn. Stat. § 412.151; or the city manager pursuant to Minn. Stat. § 412.601 – 412.751 or in charter cities as determined by city charter.

 

2.2 Department means the city water department.

 

2.3 Emergency means the declaration of a critical water deficiency by the governor.

 

2.4 Irrigation means the watering of shrubs, trees, sod, seeded areas, gardens, lawns, or any other outdoor vegetation, except outdoor vegetation utilized for agricultural purposes.

 

2.5 Notification to public means notification through local media, including interviews and issuance of news releases.

 

2.6 Public water supplier means the city or other entity that owns, manages, or operates a public water supply, as defined in Minn. Stat. § 144.382, subdivision 4.

 

2.7 Reclaimed water means water collected from rooftops, paved surfaces, or other collection devices and all water utilized more than once before re-entering the natural water cycle.

 

2.8 Water recirculation system means any system which enables a user to reuse water at least once prior to returning the water to the natural water cycle. 

 

SECTION 3. APPLICATION.

3.1 This ordinance applies to all customers of public water suppliers who own or control water use on any premises.

 

3.2 No person shall make, cause, use, or permit the use of water received from a public water supply for residential, commercial, industrial, governmental, or any other purpose in any manner contrary to any provision in this ordinance.

 

3.3 Mandatory emergency conservation measures shall be implemented based upon the declaration of a critical water emergency by the governor.

 

SECTION 4. DECLARATION OF CRITICAL WATER DEFICIENCY.

Upon the declaration of a critical water deficiency by the governor, the public water supplier shall immediately post notice of the emergency declaration at the usual meeting place of the city council, or the official city bulletin board. The city shall provide notification to the public as quickly as possible or through established water supply plans emergency response plans or procedures.

 

SECTION 5. MANDATORY EMERGENCY WATER CONSERVATION MEASURES.

Upon declaration of a water emergency and notification to the public, the following mandatory restrictions upon nonessential water use shall be enforced:

 

(1) Outdoor irrigation of yards, gardens, golf courses, parklands, and other non-agricultural land, except for those areas irrigated with reclaimed water, is prohibited.

 

(2) Washing or spraying of sidewalks, driveways, parking areas, tennis courts, patios, or other paved areas with water from any pressurized source, including garden hoses, except to alleviate immediate health or safety hazards, is prohibited.

 

(3) The outdoor use of any water-based play apparatus connected to a pressurized source is prohibited.

 

(3) Restaurants and other food service establishments are prohibited from serving water to their customers, unless water is specifically requested by the customer.

 

(5) Operation of outdoor misting systems used to cool public areas is prohibited.

 

(6) The filling of swimming pools, fountains, spas, or other exterior water features is prohibited.

 

(7) The washing of automobiles, trucks, trailers, and other types of mobile equipment is prohibited, except at facilities equipped with wash water recirculation systems, and for vehicles requiring frequent washing to protect public health, safety, and welfare.

 

SECTION 6. VARIANCES.

The Water Supervisor or their designee, is authorized to grant variances to this ordinance where strict application of its provisions would result in serious hardship to a customer. A variance may be granted only for reasons involving health or safety. An applicant may appeal the denial of a variance within five (5) days of the decision by submitting a written appeal to the City Clerk. The City Council shall hear the appeal at the next City Council meeting. The decision of the City Council is final.

 

SECTION 7. VIOLATION.

7.1 Violations shall be determined and cited by the Water Supervisor or his/her designee. A violator may appeal the citation within five (5) days of its issuance by submitting a written appeal to the City. The City Council shall hear the appeal at the next City Council meeting. The decision of the City Council is final. Violators may be granted an administrative waiver if evidence is provided that equipment failure was the cause of the violation. A letter from a qualified vendor or equipment invoice will be required to show proof of equipment failure.

 

7.2 Upon discovery of a first violation, the violator shall be issued, either personally or by mail, a warning letter that sets forth the violation, remedy, and fine.  The first occurrence of violation shall result in a $50.00 fine, which will be added to the next water bill for the premises.

 

7.3 Upon subsequent violations at the same location, the violator shall be issued, either personally or by mail, a citation that sets forth the violation and shall describe the remedy. 

Fines for subsequent violations shall be $100.00 for the second violation, $150.00 for the third violation, and $250.00 for subsequent violations, which will be added to the monthly water bill of the owner or current occupant of the premises where the violation occurred. The imposition of the fine shall in no way limit the right of the City to pursue other legal remedies.

 

SECTION 8. ENFORCEMENT.

The City Clerk or his/her designee is authorized to designate city employees or law enforcement personnel to enforce the provisions of this ordinance.

 

SECTION 9. SEVERABILITY.

If any provision of this ordinance or the application of any provision to a particular situation is held to be invalid by a court of competent jurisdiction, the remaining portions of the ordinance and the application of the ordinance to any other situation shall not be invalidated.

 

SECTION 10. EFFECTIVE DATE.

This ordinance becomes effective May 24, 2018.

THE CONSUMPTION OF INTOXICATING AND 3.2 PERCENT MALT LIQUOR

IN AND UPON PUBLIC PLACES

WITHIN THE CITY OF PARKERS PRAIRIE, MINNESOTA

 

WHEREAS, the ordinances of the City of Parkers Prairie, Minnesota currently state that subject to any Temporary Off-premise Community Festival Liquor License issued by the City, no person shall consume intoxicating liquor or 3.2 percent malt liquor in a public park, on any public street, sidewalk, parking lot or alley, or in any public place other than on the premises of an establishment licensed under this ordinance, in the City’s municipal liquor dispensary, or where the consumption and display of liquor is lawfully permitted; and

 

WHEREAS, the City Council of the City of Parkers Prairie, Minnesota has determined that it would serve the public health, morals, economic well-being, welfare, and safety of the City to enact an ordinance to allow and regulate the consumption of intoxicating and 3.2 percent malt liquor in and upon certain public property owned by the City.

 

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PARKERS PRAIRIE, MINNESOTA DOES ORDAIN:

 

Section 5 of Ordinance 2017-01, An Ordinance Regulating the Possession, Sale and Consumption of Intoxicating and 3.2 Percent Malt Liquor within the City of Parkers Prairie, Minnesota is hereby amended as follows:

 

Section 5.  CONSUMPTION IN PUBLIC PLACES. 

 

(A) Consumption Generally. Subject to Subparts (B) and (C) of this Section or any Temporary Off-premise Community Festival Liquor License issued pursuant to Section 29(I) of this ordinance, no person shall consume intoxicating liquor or 3.2 percent malt liquor in a public park, on any public street, sidewalk or parking lot, or in any public place other than on the premises of an establishment licensed under this ordinance, in the City’s municipal liquor dispensary, or where the consumption and display of liquor is lawfully permitted.

 

(B) Consumption at Prairie Event Center. Intoxicating liquor or 3.2 percent malt liquor may be sold, possessed, displayed and consumed at the Prairie Event Center under the following circumstances only:

 

(1) When it is dispensed or sold by a vendor that has been authorized by the City Council to dispense or sell it at conventions, banquets, conferences, meetings, and social affairs conducted at the Prairie Event Center, and only during such a convention, banquet, conference, meeting, social affair that is hosted by a user or user group that has executed a written lease or similar use agreement with the City. 

 

(2) Individuals may consume their personal intoxicating liquor or 3.2 percent malt liquor at the Prairie Event Center only if attending a meeting of a civic group which has entered into an agreement with the City to rent meeting space at the Prairie Event Center at least twelve (12) times per year. For these purposes, a “civic group” is: (a) any Minnesota nonprofit corporation organized pursuant to Minnesota Statutes, Chapter 317A and with tax exempt status pursuant to Section 501(c)(3) or 501(c)(4) of the United States Internal Revenue Code; or (b) any local chapter of a nationally-recognized nonprofit corporation with such tax exempt status.

 

(3) Under no circumstances may intoxicating liquor or 3.2 percent malt liquor be stored at the Prairie Event Center when an event specified in this Subpart (B) is not taking place. All intoxicating liquor and/or 3.2 percent malt liquor must be removed from the Prairie Event Center immediately after the conclusion of each event.

 

(C) Consumption in City Parks. Intoxicating liquor or 3.2 percent malt liquor may not be possessed, displayed or consumed in any City park, except in those permanent City Park shelters which, in consultation with the Chief of Police, the City Council may designate via prominent signage as locations where such possession, display and consumption is permitted.
