Parkers Prairie ISD #547 requests proposals for group insurance coverage for the health plan year beginning July 1, 2019.   Sealed proposals will be accepted in paper form until 4:00 pm central time on March 21, 2109 at Parkers Prairie School District, PO Box 46 Parkers Prairie, MN 56361.  Copies of the request for proposal and exhibits may be requested from Dean Yocum dyocum@pp.k12.mn.us, and will be sent electronically at no charge.  District reserves the right to reject any or all bids and to waive informalities.  District reserves the right to select the proposal which it determines to be in the best interest of the District.

You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no court file number on this Summons.


2. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. 3. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiffs’ Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiffs should not be given everything asked for in the Complaint, you must say so in your Answer.


4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within 20 days, you will lose this case. You will not get to tell your side of the story, and the Court may decide against you and award the Plaintiffs everything asked for in the Complaint. If you do not want to contest the claims stated in the Complaint, you do not need to respond. A default judgment can then be entered against you for the relief requested in the Complaint.

ORDINANCE NO. 2019-01

AN ORDINANCE AMENDING ORDINANCE NO. 2017-02 

RELATING TO THE POSSESSION, SALE AND CONSUMPTION  

OF INTOXICATING AND 3.2 PERCENT MALT LIQUOR 

WITHIN THE CITY OF PARKERS PRAIRIE, MINNESOTA


WHEREAS, the City of Parkers Prairie, Minnesota (“City”) no longer owns or operates an on- or off-sale liquor store; and


WHEREAS, the City Council for the City of Parkers Prairie previously passed Ordinance No. 2017-02,  An Ordinance Relating to the Possession, Sale and Consumption  of Intoxicating and 3.2 Percent Malt Liquor within the City of Parkers Prairie, Minnesota (“2017 Liquor Ordinance”); and


WHEREAS, the City Council subsequently determined that issuing on- and off-sale liquor licenses to other qualified enterprises would serve the public interest and therefore passed Ordinance 2018-01 amending the 2017 Liquor Ordinance; and


WHEREAS, the City Council has now determined that issuing combination on-sale and off-sale intoxicating liquor licenses to other qualified enterprises would also serve the public interest; and


WHEREAS, Minnesota Statutes, § 340A.406 allows the City Council to issue combination on-sale and off-sale intoxicating liquor licenses; and


WHEREAS, the City Council has determined that amending the 2017 Liquor Ordinance is needed in order to authorize the issuance of combination on-sale and off-sale intoxicating liquor licenses.


NOW, THEREFORE, IT IS HEREBY ORDAINED by the City Council for the City of Parkers Prairie, that the following sections of the 2017 Liquor Ordinance are amended as follows. 


The definition for “Restaurant” in Section 3 is amended as follows:


SECTION 3.  DEFINITIONS.


RESTAURANT.  An eating facility, other than a hotel, under the control of a single proprietor or manager, where meals are regularly prepared on the premises, where full waitress/waiter table service is provided, where a customer orders food from printed menus and where the main food course is served and consumed while seated at a single location. To be a restaurant as defined by this section, an establishment shall have a license from the state as required by Minn. Stat. § 157.16, as it may be amended from time to time, and meet the definition of either a “Category 1 establishment,” “Category 2 establishment,” or “Category 3 establishment” as defined in Minn. Stat. § 157.16, subd. 3(d), as it may be amended from time to time. An establishment which serves prepackaged food that receives heat treatment and is served in the package or frozen pizza that is heated and served, shall not be considered to be a restaurant for purposes of this ordinance unless it meets the definitions of a “Category 1 establishment,” “Category 2 establishment,” or “Category 3 establishment.”


The following definition for “Exclusive Liquor Store” shall be added to Section 3:


Section 3.  DEFINITIONS.


EXCLUSIVE LIQUOR STORE. “Exclusive liquor store” is an establishment used exclusively for the sale of those items authorized in Minnesota Statutes, § 340A.412, subdivision 14, as the same may be amended from time to time. An exclusive liquor store may serve food under Minnesota Statutes § 340A.412, Subd. 14 (b), as the same may be amended from time to time, so long as service of those food items does not require a license under Minnesota Statutes § 157.16, as that statute may be amended from time to time.


Section 7 shall be amended as follows:


SECTION 7.  NUMBER OF LICENSES WHICH MAY BE ISSUED.


(A) On-Sale Licenses.  The number of on-sale licenses which may be granted under this ordinance is four (4), even if a larger number of licenses are authorized by law or election. The Council in its sound discretion may provide by ordinance that a larger number of on-sale licenses may be issued up to the number of licenses authorized by Minn. Stat. Ch. 340A, as it may be amended from time to time. If a larger number of on-sale licenses in a particular category has been authorized by a referendum held under the provisions of Minn. Stat. § 340A.413, subd. 3 as it may be amended from time to time, but not all of them have been issued, the larger number of licenses is no longer in effect until the Council by ordinance determines that any or all of the licenses may be issued. The Council is not required to issue the full number of licenses that it has available. For the purposes of calculating this cap, the exclusions set forth in Minn. Stat. § 34A0A.413, Subd. 4, as the same may be amended from time to time, shall apply.


(B) Off-Sale Licenses.  The number of off-sale licenses of off-sale licenses which may be granted under this ordinance is four (4).


(C) Combination Licenses.  A combination license is both an “off-sale” and an “on-sale” license, and counts against both caps established in Section 7(A) and (B).


Section 18(B) shall be amended as follows:


SECTION 18.  RESTRICTIONS ON ISSUANCE.


(B) An on-sale and an off-sale license or a combination license may be issued to one person pursuant to Minn. Stat. § 340A.406, as the same may be amended from time to time.


Section 29 shall be amended as follows:

Section 29.  ISSUANCE OF OTHER LICENSES.

(B) Off-sale licenses for the sale of intoxicating liquor. The Council may issue in its sound discretion an off-sale license for the sale of intoxicating liquor to exclusive liquor stores or as part of a combination license. 


The following clause (J) will be added to Section 29:


(J) Combination licenses. The Council may in its sound discretion issue a combination license under Minn. Stat. § 640A.406, as it may be amended from time to time, in lieu of issuing a separate on-sale and off-sale license to the same person. For the purposes of Section 7, a Combination License is both an on-sale license and an off-sale license.  Therefore, when a combination license is issued, it is one of the four on-sale licenses that may be issued per § 7(A) of this ordinance, and it is one of the four off-sale licenses that may be issued per § 7(B) of this ordinance. Provided, however, that if the combination license is issued to an establishment that is excluded from the cap per Minn. Stat. § 340A.413, Subd. 4, it shall count toward the off-sale cap in § 7(B) but not toward the on-sale cap in § 7(A).


The following clause (K) shall be added to Section 31:


(K) Combination Liquor: $1,440.00.


EFFECTIVE DATE February 28, 2019


This ordinance shall become effective upon its passage and publication in the manner established by Resolution No. 2018-08 of the City Council.

The regular meeting of the Board of Education of Independent School District 547, Parkers Prairie Public Schools, was called to order by Steve Inwards at 7:00 p.m.  Board members present: Lyle Oeltjenbruns, Judy Moeller, Glenn Cornish, Scott Wagner, Jeff Samuelson and Christy Hart.  Absent: None. Student Board Members present:  None.  Administration present: Superintendent Dean Yocum, Secondary Principal Carey Johnson and Elementary Principal Steve Radtke. Also present: Roger Rewitzer, Kris Wagner, Hannah Samuelson, Jenni Marquardt and Tammy Larson.

Motion by Oeltjenbruns, seconded by Wagner and carried, to approve the amended agenda. 

Organizational Business:

• Member Steve Inwards called for the election of officers. Nominations for officers were made and approved as follows:

• Motion by Moeller, seconded by Oeltjenbruns and carried, to set the schedule for the next twelve regular board meetings as the second Thursday of each month at 7:00 p.m. in the High School media center.

• Motion by  Samuelson, seconded by Hart and carried, to designate the law firm of Ratwik, Roszak & Maloney, PA., as the District’s official legal counsel, with the Board chair, Superintendent or their designees authorized to contact legal counsel. • Motion by Oeltjenbruns, seconded by Wagner and carried to table Board committee assignments until the February meeting.

• Motion by  Cornish, seconded by Wagner to set 2019 Board meeting compensation at $1,080/year for directors, $1,320/year for the Chairman, Clerk and Treasurer, $250/year extra for negotiators, when in negotiations.  Motion passed.

• Discussion was held regarding the recent snow day.  Motion by Oeltjenbruns, seconded by Wagner and carried to leave the 2018-19 calendar as is.  The snow day on January 7th will not be made up.

• Superintendent Yocum has several options for the 2019-2020 school calendar.  Drafts will be provided to School Board members for review prior to meeting with additional parties.

• The topic of providing Board information in electronic form was discussed.  Motion by Cornish, seconded by Samuelson and carried to continue receiving the Agenda summary and detail reports in hard copy.  Board payable reports are provided to Board members electronically and will be available to the public in hard copy.

WHEREAS, the District 547 School Board encourages the support of the district’s educational programs through the funding and support of grant opportunities and donations that meet the goals and objectives of the school district; 

WHEREAS, the school district will control and maintain all grants and donations to ensure that the interests of all students are met; 

WHEREAS, the grants and donations listed below have been reviewed and approved by the administration of School District 547; 

THEREFORE, BE IT RESOLVED, by the School Board of Independent School District No. 547, State of Minnesota, to accept the following donations:

*In memory of Kevin Revering for $100 to Fishing League and Clay Trap Team - $50 Each. 

*Parkers Prairie Sportsmen Club for $3,500 to the 2019 Prom.

• Preliminary Seniority lists were presented for Classified employees.  These will be posted in each school for 30 days and on the February agenda for approval.

• A RESOLUTION TO COMBINE THE DUTIES OF THE OFFICES OF CLERK AND TREASURER was introduced by member Samuelson, and seconded by Cornish.  The resolution was unanimously passed and is now in full force and effect:  

WHEREAS, Minnesota Statutes 123B.14, Subd. 1, empowers the School Board to combine the duties of the offices of Clerk and Treasurer of the School Board in one person in the Office of Business Affairs of the School District. 

WHEREAS, the School District has decided to combine the duties of the Clerk and Treasurer in one person in the Office of Business Affairs. THEREFORE, BE IT RESOLVED THAT the Business Manager of the School District is designated by the School Board of Independent School District No. 547 to perform the duties of Clerk and Treasurer of the District.

• Motion by Oeltjenbruns, seconded by Moeller and carried, to approve an extended leave of absence for Mike Johnson.

• Motion by Moeller, seconded by Cornish and carried, to hire Tanya Makela as a long-term substitute for Mike Johnson.
