It is Ordered and Notice is given that on April 24, 2018, at 1:30 p.m., a hearing will be held in this Court at 121 West Junius Avenue, Fergus Falls, Minnesota, for the adjudication of intestacy and determination of heirship of the Decedent, and for the appointment of Teresa Mary Terfehr, whose address is 52 Central Avenue South, Parkers Prairie, MN 56361, as Personal representative of the Estate of the Decedent in an UNSUPERVISED administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate, including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.

 

Notice is also given that (subject to Minnesota Statutes section 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

If you believe the value or classification of your property is incorrect, please contact your assessor’s office to discuss your concerns.  If you disagree with the valuation or classification after discussing it with your assessor, you may appear before the local board of appeal and equalization.  The board will review your assessments and may make corrections as needed.  Generally, you must appeal to the local board before appealing to the county board of appeal and equalization.

AN ORDINANCE AMENDING ORDINANCE NO. 2017-__

RELATING TO THE POSSESSION, SALE AND CONSUMPTION

OF INTOXICATING AND 3.2 PERCENT MALT LIQUOR

WITHIN THE CITY OF PARKERS PRAIRIE, MINNESOTA

WHEREAS, the City of Parkers Prairie, Minnesota (“City”) presently owns and operates an on- and off-sale liquor store, which is known as the Parkers Prairie Liquor Store and which is located at 405 North Otter Avenue, Parkers Prairie, Minnesota; and

WHEREAS, on February 20, 2018 the City Council for the City determined that based on the historical financial performance of the Parkers Prairie Liquor Store, it would be in the public interest to proceed with the sale of the Parkers Prairie Liquor Store and that upon such sale it would also be in the public interest for the City to cease all on- and off-sale liquor sales by the City; and

WHEREAS, the City has already begun the process of attempting to sell the Parkers Prairie Liquor Store; and

WHEREAS, so long as the City owns and operates the Parkers Prairie Liquor Store, state law prohibits the issuance of licenses for the off-sale of intoxicating liquor and, therefore, the City’s ordinances do not presently provide for the issuance of such licenses; and

WHEREAS, the City Council has further determined that upon its sale of the Parkers Prairie Liquor Store and its cessation of the on- and off-sale of intoxicating liquor, it would then be in the public interest for the City Council to have the authority to issue licenses to private parties for the off-sale of intoxicating liquor; and

WHEREAS, the City Council has determined that this ordinance is needed in order to authorize the issuance of off-sale intoxicating liquor licenses.

NOW, THEREFORE, IT IS HEREBY ORDAINED by the City Council for the City of Parkers Prairie, that the following sections of Ordinance 2017-__ are hereby amended as follows.

The following definition for “Exclusive Liquor Store” shall be added to Section 3:

SECTION 3. DEFINITIONS.

EXCLUSIVE LIQUOR STORE. “Exclusive liquor store” is an establishment used exclusively for the sale of those items authorized in Minnesota Statutes, § 340A.412, subdivision 14, as the same may be amended from time to time.

Section 5 shall be amended as follows:

SECTION 5. CONSUMPTION IN PUBLIC PLACES. Subject to any Temporary Off-premise Community Festival Liquor License issued pursuant to Section 29(I) of this ordinance, no person shall consume intoxicating liquor or 3.2 percent malt liquor in a public park, on any public street, sidewalk, parking lot or alley, or in any public place other than on the premises of an establishment licensed under this ordinance or where the consumption and display of liquor is lawfully permitted.

Sections 25 through 28 and 29(B) shall be amended as follows:

SECTION 25. MUNICIPAL LIQUOR STORE.

Upon the closing on a sale of the on and off-sale municipal liquor store owned and operated by the City, the City shall cease the ownership and operation of a municipal liquor store as otherwise authorized by Minnesota Statutes § 340A.601. Provided, however, that nothing herein shall prevent the City from re-establishing, owning and operating a municipal liquor store in the future.

SECTION 26. RESERVED FOR FUTURE USE.

SECTION 27. RESERVED FOR FUTURE USE.

SECTION 28. RESERVED FOR FUTURE USE.

SECTION 29. ISSUANCE OF OTHER LICENSES.

(B) Off-sale licenses for the sale of intoxicating liquor. The Council may issue in its sound discretion an off-sale license for the sale of intoxicating liquor only to exclusive liquor stores.

Section 31 shall be amended as follows:

SECTION 31. FEE SCHEDULE. The fees for the licenses allowed by this ordinance shall be as follows:

(A) On-sale Intoxicating Liquor: $1,200.00.

(B) On-sale 3.2 Percent Malt Liquor: $65.00.

(C) Off-sale 3.2 Percent Malt Liquor: $25.00.

(D) On-sale Wine: $150.00.

(E) Temporary On-sale Intoxicating Liquor: $50.00 per event.

(F) Consumption and Display License: $150.00.

(G) On-sale Sunday Intoxicating Liquor: $200.00.

(H) Temporary Off-Premise Community Festival Liquor: $100.00 per event.

(I) Club On-Sale: Statutory Maximum per Minn. Stat. § 340A.408, as the same may be amended.

(J) Off-sale Intoxicating Liquor: Statutory Maximum per Minn. Stat. § 340A.408, as the same may be amended.

EFFECTIVE DATE

This ordinance shall become effective upon the following: (1) this ordinance is approved and published in the manner established by Resolution of the City Council; and (2) the successful closing on a sale of the on- and off-sale municipal liquor store presently owned and operated by the City.
